Rules and guidelines for using ToknGram

1. Agreement to Terms

By accessing or using the ToknGram website and services (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service.

2. Description of Service

ToknGram provides a web-based service that allows users to download videos from Instagram and TikTok without watermarks for personal, non-commercial use. The Service processes URLs provided by users to extract, modify, and deliver video content.

3. User Eligibility

You must be at least 13 years of age to use this Service. By using the Service, you represent and warrant that you meet the eligibility requirement. If you are under 18 years of age, you represent that you have your parent or guardian's permission to use the Service.

4. Acceptable Use Policy

When using our Service, you agree not to:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law
  • Violate or encourage others to violate the rights of third parties, including intellectual property rights
  • Use automated scripts, bots, or other software to access or interact with the Service
  • Attempt to circumvent any technological measure implemented by ToknGram to protect the Service
  • Use the Service to download content that is illegal, pornographic, or otherwise objectionable
  • Redistribute, sell, license, or commercially exploit any videos downloaded using the Service
  • Impersonate any person or entity or falsely state or misrepresent your affiliation with a person or entity
  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Attempt to probe, scan, or test the vulnerability of the Service or any associated system or network
  • Collect or harvest any personally identifiable information from the Service

5. Intellectual Property Rights

5.1 Our Intellectual Property

The Service, including its original content, features, and functionality, is owned by ToknGram and is protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not duplicate, copy, or reuse any portion of the HTML/CSS, JavaScript, visual design elements, or concepts without express written permission from ToknGram.

5.2 Third-Party Content

ToknGram does not claim ownership of the content that users download through our Service. The videos available on Instagram and TikTok are owned by their respective creators or the platforms themselves. By using our Service, you acknowledge that:

  • You are solely responsible for ensuring you have the right to download and use the content
  • You will use downloaded content in a manner that complies with applicable laws and respects the rights of the original creators
  • You will not redistribute, sell, or otherwise commercially exploit downloaded content without proper authorization

6. User Responsibilities and Content

6.1 Content Ownership

ToknGram does not claim ownership over the videos you download using our Service. However, you represent and warrant that you have the legal right to download and use such content for your intended purpose.

6.2 Copyright Infringement

ToknGram respects the intellectual property rights of others and expects users to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us. If you believe that your content has been copied in a way that constitutes copyright infringement, please provide us with the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed
  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and email address
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
  • A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

We reserve the right to remove content alleged to be infringing without prior notice, at our sole discretion, and without liability to you.

7. Disclaimers

7.1 Service Availability and Quality

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TOKNGRAM MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE OPERATION OR AVAILABILITY OF THE SERVICE. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

7.2 Content Quality and Accuracy

TOKNGRAM DOES NOT WARRANT THAT THE QUALITY OF ANY VIDEOS, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS. We make no guarantees regarding the quality, resolution, or formatting of downloaded videos.

7.3 Third-Party Services

Our Service may contain links to third-party web sites or services that are not owned or controlled by ToknGram. ToknGram has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TOKNGRAM, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE.

9. Indemnification

You agree to defend, indemnify, and hold harmless ToknGram and its licensors, service providers, officers, directors, agents, and employees, from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your use of the Service or your violation of these Terms.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which ToknGram is established, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

14. Waiver and Severability

The failure of ToknGram to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

15. Entire Agreement

These Terms constitute the entire agreement between you and ToknGram regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
